These Terms of Use (“Terms”) govern access to and use of BookBildr for Education, edu.bookbildr.com, the BookBildr book editor and related subscription, PDF, AI illustration and print-on-demand services (collectively, the “Service”).
The Service is provided by BookBildr LLC, with its business address at 7901 4th St N, Suite 300, St. Petersburg, Florida 33702, USA (“BookBildr,” “we,” “us” or “our”).
By creating an account, purchasing a subscription, accepting an invitation or using the Service, you agree to these Terms.
If you use BookBildr on behalf of a school, organization or other entity, you confirm that you are authorized to accept these Terms on its behalf.
1. Eligibility and student use
Adults creating a plan-owner, teacher, administrator or billing account must be at least 18 years old and legally able to enter into a contract.
Students and other minors may use the Service only under the authorization and supervision of a school, teacher, parent or legal guardian.
A child under 13 may not independently create or use a BookBildr account. Their use must be authorized through an appropriate school-directed or parent-authorized arrangement.
BookBildr remains responsible for its own legal obligations relating to children’s privacy. These Terms do not transfer BookBildr’s legal responsibilities to a school or teacher.
2. Accounts and group memberships
You must provide accurate registration information and keep it reasonably current.
You are responsible for:
- Protecting your account password
- Activities performed through your account
- Promptly notifying us of suspected unauthorized access
- Inviting only authorized members to your group
- Removing users who should no longer have access
- Selecting a plan with enough available member accounts
Plan owners may manage group membership but may not impersonate members or access private student projects except through features that permit project sharing, feedback or administration.
Accounts and invitations may not be sold, transferred or shared with unauthorized users.
3. Educational organizations
Schools and educational organizations are responsible for determining whether BookBildr is appropriate for their intended educational use and for obtaining any approvals required from their administration, parents or guardians.
BookBildr will provide information reasonably needed for a school’s privacy and security assessment. Schools requiring a separate data-processing agreement should contact us before creating student accounts.
The Service must not be used to collect unnecessary sensitive information about students.
BookBildr remains responsible for complying with legal obligations that apply directly to BookBildr.
4. Subscriptions and free trials
BookBildr offers monthly subscription plans with the prices, member limits and features shown at registration or checkout.
Unless stated otherwise:
- Education group plans begin with a seven-day free trial.
- The Personal plan begins with a three-day free trial.
- A valid payment method may be required to begin a trial.
- The selected subscription automatically becomes paid when the trial ends unless it is cancelled before that time.
- Paid subscriptions renew every 30 days until cancelled.
The price, trial period, member limit and included features displayed during checkout form part of your purchase agreement.
You are responsible for cancelling before the trial ends if you do not want the subscription to become paid.
5. Payments and taxes
Payments may be processed by Stripe, PayPal or another payment provider identified at checkout.
You authorize the applicable payment provider to charge the selected payment method for subscription fees, taxes and purchases that you approve.
You are responsible for applicable taxes, currency-conversion charges and payment-provider fees unless the checkout page states otherwise.
BookBildr does not receive or store complete credit-card details.
If a payment fails, we may:
- Retry the payment
- Ask you to update the payment method
- Restrict subscription features
- Suspend the subscription until payment is completed
6. Cancellation, account deletion and refunds
You may cancel recurring billing through the available account or subscription controls.
If you cancel during a free trial, you will not be charged provided the cancellation is completed before the trial ends.
If you cancel a paid subscription:
- The subscription normally remains active until the end of the paid billing period.
- It will not renew for another billing period.
- Payments are generally non-refundable after a billing period has started.
- Refunds will be provided where required by applicable law or expressly agreed by BookBildr.
Cancelling recurring billing does not automatically delete the account or its book projects.
When a subscription expires, the plan owner and group members may lose access to subscription features. Users should download required PDF files before the subscription ends.
If you request complete account deletion:
- The account will be deleted immediately.
- Every book project associated with the account will be permanently deleted.
- Uploaded images, text, layouts, comments and saved generated illustrations will be deleted.
- The account and projects will not be retained in BookBildr backups.
- The deleted information cannot be recovered or restored.
Complete account deletion is final and irreversible.
BookBildr may retain the minimum payment, invoice, tax or legal records required by law. These records cannot be used to restore the deleted account or projects.
7. Changes to plans and prices
We may change plan features, limits or prices from time to time.
A price increase for an existing paid subscription will normally apply from a future renewal after reasonable notice unless immediate action is required by law, taxation changes or correction of an obvious pricing error.
You may cancel before the new price becomes effective.
A change to a plan does not entitle the user to a refund for a billing period that has already started, except where required by law.
8. Book creation and PDF files
BookBildr provides tools for writing, illustrating, arranging and downloading books.
Users are responsible for reviewing their books before downloading a PDF or ordering printed copies.
Screen previews may differ slightly from downloaded or printed results because of differences in:
- Fonts
- Colour reproduction
- Paper
- Trimming
- Binding
- Printing equipment
- Screen settings
Users should follow BookBildr’s preparation, image-resolution and safe-margin guidance.
BookBildr does not guarantee that every uploaded image, font or layout will produce identical results on every device or in print.
9. Printed books
Printed-book orders may be fulfilled by Lulu Inc. or another disclosed printing partner.
Printing and delivery are separate from the subscription fee unless checkout expressly states otherwise.
Before ordering, the customer is responsible for checking:
- Text and spelling
- Page order
- Image quality and resolution
- Margins and cropping
- Book dimensions
- Binding
- Delivery information
Because printed books are individually produced from user-provided content, they may not be returnable merely because the customer changes their mind.
This does not affect rights relating to defective, damaged or incorrectly produced goods.
Production and delivery estimates are not guaranteed. BookBildr is not responsible for delays caused by:
- Carriers
- Customs
- Incorrect delivery information
- Printing-partner delays
- Weather
- Labour disruption
- Events outside BookBildr’s reasonable control
10. Ownership of book content
As between the user and BookBildr, the user retains ownership of the original text, images and other book content they create or lawfully upload.
BookBildr does not claim ownership of a user’s completed book.
You grant BookBildr a limited, non-exclusive licence to host, copy, process, display and transmit your content only as reasonably necessary to:
- Operate the editor
- Save and display projects
- Enable project sharing and teacher feedback
- Generate requested illustrations
- Create PDF and print-ready files
- Fulfil printing orders
- Provide technical support
- Maintain security
- Comply with legal obligations
This licence ends when the content is permanently deleted, except where a third-party provider or applicable law requires limited retention of transaction or processing records.
11. Content responsibilities
You may upload or use content only when you have the necessary rights and permissions.
You must not use the Service to create, upload, request or distribute content that:
- Is illegal or facilitates illegal activity
- Exploits, sexualizes or endangers a child
- Is sexually explicit or pornographic
- Promotes hatred, harassment or violence
- Invades another person’s privacy
- Contains confidential personal information without authorization
- Infringes copyright, trademark or other intellectual-property rights
- Is fraudulent, deceptive or defamatory
- Contains malware
- Attempts to compromise the Service
- Impersonates another person
- Violates applicable school policies or law
Teachers, parents and organizations are responsible for providing reasonable supervision appropriate to the age of student users.
BookBildr may remove or restrict access to content that appears to violate these Terms.
12. AI-generated illustrations
Some plans include access to AI illustration features provided through the OpenAI API.
Prompts and outputs submitted through the OpenAI API are not used to train or improve OpenAI’s models.
Under OpenAI’s standard retention practices, prompts and outputs may be retained for abuse and misuse monitoring for up to 30 days, unless longer retention is legally required.
AI-generated results are produced automatically and may be:
- Inaccurate
- Unsuitable
- Unexpected
- Similar to content generated for another user
- Ineligible for copyright protection
- Potentially subject to third-party rights
BookBildr does not guarantee that AI-generated output is unique, copyrightable or free from all third-party claims.
Users must review AI-generated material before using, sharing, downloading or printing it.
Users must not include sensitive personal information in AI prompts or use the AI feature to create prohibited content.
BookBildr may block prompts or generated material that appears to violate these Terms.
Teachers and supervising adults are responsible for guiding student use of AI features.
13. BookBildr materials and intellectual property
The Service, software, interface, BookBildr name, logos, templates and BookBildr-provided materials are owned by BookBildr or its licensors.
Subject to these Terms, BookBildr grants users a limited, personal, non-exclusive and non-transferable right to use the Service during an active account or subscription.
You may not:
- Copy or redistribute the Service itself
- Reverse engineer the Service
- Attempt to extract its source code
- Circumvent account, subscription or security restrictions
- Use automated systems to scrape or overload the Service
- Resell access without written permission
- Misrepresent an affiliation with BookBildr
- Use BookBildr branding without permission
Rights to images from BookBildr’s illustration library may be subject to specific licence conditions displayed with the library or Service.
Users should not assume that every provided image may be redistributed separately from a BookBildr-created book.
14. Copyright complaints
If you believe content available through BookBildr infringes your copyright or other intellectual-property rights, you may submit a complaint through the contact form.
The complaint should identify:
- The protected work
- The allegedly infringing content
- Where the content appears
- Your relationship to the protected work
- Information allowing us to respond to the complaint
- A statement that the information in the complaint is accurate
We may remove or restrict access to disputed content while investigating a complaint.
15. Privacy
Our collection and use of personal information are described in the BookBildr Privacy Policy.
Schools and organizations should review the Privacy Policy before inviting students.
BookBildr’s website, application, databases and book projects are hosted in the United States.
16. Service availability
We work to keep BookBildr available and protect saved projects, but uninterrupted access cannot be guaranteed.
The Service may occasionally be unavailable because of:
- Maintenance
- Upgrades
- Network failures
- Software errors
- Security incidents
- Third-party service interruptions
- Circumstances outside our reasonable control
Users should download copies of important completed work.
BookBildr is not intended to serve as the sole permanent archive for irreplaceable material.
17. Suspension, termination and deletion
We may restrict or suspend an account when reasonably necessary to:
- Address a security risk
- Investigate suspected unauthorized use
- Prevent harm to a child or another person
- Respond to unlawful or prohibited content
- Address non-payment
- Enforce these Terms
- Comply with legal requirements
Where appropriate, we will provide notice and an opportunity to correct the issue.
We may immediately suspend access when delay could create a significant legal, security or safety risk.
Users may stop using the Service and request complete account deletion at any time.
Complete deletion is immediate and irreversible. It permanently removes the account and every associated book project, including uploaded images, text, layouts, comments and saved generated illustrations.
Deleted accounts and projects are not retained in BookBildr backups and cannot be restored.
Minimum payment, invoice, tax or legal records may be retained separately where required by law.
18. Third-party services
The Service depends on third parties for functions such as:
- Payments
- Hosting
- Security
- Website analytics
- AI illustration generation
- Printing
- Delivery
Third-party services may be governed by their own terms and privacy policies.
BookBildr is not responsible for third-party services outside BookBildr’s reasonable control. This does not limit any responsibility that applicable law places directly on BookBildr.
19. Disclaimers
The Service is provided on an “as available” basis.
To the maximum extent permitted by law, BookBildr does not guarantee that:
- The Service will always be uninterrupted or error-free
- Every browser, device or third-party system will remain compatible
- AI output will be accurate, unique or suitable
- User content will comply with intellectual-property laws
- Printed colours and dimensions will exactly match screen previews
- Every file or project will remain available indefinitely
- Third-party services will always remain available
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
20. Limitation of liability
To the maximum extent permitted by law, BookBildr will not be liable for indirect, incidental, special or consequential losses, including loss of profits, loss of opportunity or loss of data, arising from use of the Service.
BookBildr’s total liability arising from the Service will not exceed the greater of:
- The amount paid by the claimant to BookBildr during the 12 months before the event giving rise to the claim; or
- USD $100.
These limits do not apply where liability cannot legally be limited, including liability for fraud, wilful misconduct or other matters that applicable law excludes from limitation.
21. Responsibility for claims
An adult plan owner or organization agrees to be responsible for claims arising from its unlawful content, infringement of third-party rights or material breach of these Terms.
This section does not apply to a child user.
It does not require anyone to compensate BookBildr for BookBildr’s own unlawful conduct, negligence or breach.
22. Governing law and jurisdiction
These Terms are governed by the laws of the State of Florida and the applicable federal laws of the United States, without regard to conflict-of-law principles.
Any legal proceeding arising from these Terms or the Service may be brought in the state or federal courts serving Pinellas County, Florida. Each party consents to the jurisdiction of those courts.
This provision does not override any mandatory consumer, privacy or other legal rights that allow a user to bring a claim in another jurisdiction.
Nothing in these Terms prevents either party from seeking urgent relief to protect safety, confidential information or intellectual-property rights.
23. Changes to these Terms
We may update these Terms to reflect changes in the Service, law or business practices.
The revised Terms will be posted with a new effective date.
If a change materially affects an active paid subscription, we will provide reasonable notice where practicable.
Continued use after the change becomes effective constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you may stop using the Service and cancel your subscription.
24. General provisions
If one part of these Terms is found unenforceable, the remaining provisions will continue in effect.
Failure to enforce a provision is not a waiver of the right to enforce it later.
You may not transfer your agreement or account without written permission from BookBildr.
BookBildr may transfer these Terms as part of a merger, acquisition, reorganization or sale of the business or Service.
These Terms, together with the Privacy Policy and information displayed during checkout, form the agreement between you and BookBildr concerning the Service.
